Justice Mugambi Calls for Chief Justice's Intervention in Deputy President's Impeachment Case

In today’s ruling, Justice Lawrence Mugambi highlighted that the impeachment proceedings against the Deputy President raised significant constitutional questions, warranting the Chief Justice's intervention.

This decision follows a statement from the Deputy President’s legal team, led by Senior Counsel Paul Muite, which argued that the impeachment process involving Gachagua presented multiple constitutional concerns. This marks the first time the country has faced such an impeachment under the new constitution.Muite emphasized that the impeachment of a Deputy President differs from that of a President or a Governor. He also noted that the motion against Gachagua lacked sufficient public involvement. Additionally, the lawyers argued that Gachagua should have been given the opportunity to respond to the 11 charges against him before public participation could take place, allowing citizens to make informed decisions.

With the case now under Senate review, the lawmakers will evaluate all 11 charges, giving the Deputy President a chance to respond. Gachagua will have four hours to defend himself with the support of his legal team. During the proceedings, both the National Assembly and Gachagua’s team will call witnesses who will testify before the Senators.
