Okiya Omtatah Discloses Why He Voted No Towards Gachagua's Impeachment

Busia senator Okiya Omtatah has made public the reasons as to why he voted no regarding impeachment of Rigathi Gachagua.

Omtatah who is a renowned activist noted that he felt that Gachagua was rushed and he should have been given an ample opportunity to defend himself in the Senate.

He further stated that  he was satisfied with the grounds levelled for his impeachement

 "Even me I had questions for him to clarify and I didn't get the chance to ask them. I voted No to all the charges because I don't believe that I can live with my conscious, condemning a man to such a sentence when I am not convinced above reasonable doubt,"Omtatah said further adding that he doesnt bank on the courts to rescue embattled Gachagua basing on what is already being experienced.

 "He should try the courts. But given the level of state capture I don't see him a very good chance. Let's wait and see what happens,"Omtatah added.

Gachagua's quest to reclaim his postion is facing mutliple hardles, yesterday the president moved to court to challenge his petition against his impeachment.

Through lawyer Adrian Kamotho, President William Ruto has filed a preliminary objection in a petition against Gachagua's impeachment.

President ruto argues that the court lacks jurisdiction to hear and determine the petition, arguing it is abuse of court process.

"The Petition herein has been filed in this Honourable Court in clear disregard of the law, is an abuse of the due process of court, hence cannot be countenanced and/or determined by this Honorable Court," reads court documents.

While asking the court to dismiss the case ,Ruto stated  that civil proceedings cannot be instituted in any court against the President or the person performing the functions of the office of the President during their tenure of office in respect of anything done or not done under the Constitution of Kenya 2010.

Petitioners David Mathenge, Peter Kamotho, Grace Mwangi, Clement Muriuki and Edwin Kariuki moved to court to block DP-nominee Kithure Kindiki from assuming office. 

President William Ruto has been  mentioned as the fifth respondent in the case whereas the impeached deputy president is named as an interested party.
