Gachagua's  Lawyers Put Deputy Chief Justice Philomena Mwilu On The spot

There has been a heated exchange this afternoon at Milimani locals regarding the powers of the  Vice President of the Supreme Court of Kenya.

Embattled Deputy President Rigathi Gachagua's lawyers, Ndegwa Njiru and Paul Muite, sought to understand why Deputy Chief Justice Philomena Mwilu  would go ahead and appoint a three-judge bench without Chief Justice Martha Koome's consent.

Her conduct and powers have been put on the spot resulting to heated exchanges.

Lawyer Mungai: The right to a fair hearing is being sacrificed. The Deputy Chief Justice is biased and has empaneled this bench to hear the applications of the State
Justice Ogola: Don’t bring up the DCJ’s conduct. She discharged her administrative duties
Lawyer Kibe Mungai: The Deputy Chief Justice cannot appoint any judge bench. This is unconstitutional
Senior Counsel Paul Muite: With utmost respect, this is a court of record. In order to be systematic, accurate, and easy to follow, may I request that we get clarity on which petition files are before this court?
Justice Eric Ogola: I have heard you
Few days ago Philomena Mwilu gave her opinion on how Gcahagua's matters would be handled had they landed in court.

If it comes back to the courts, after the Senate, it is a case like the next case. It will be handled by we who sit in the Judiciary in the manner the Constitution has authorized us to do,We can't go outside the constitution,  we can't go outside the law" she reiterated.
