Law Society of Kenya Criticizes Supreme Court Over Finance Act Ruling
The Law Society of Kenya (LSK), led by its president Faith Odhiambo, has criticized the Supreme Court over its recent ruling on the Finance Act, 2023, specifically concerning the public participation conducted before its passage. In its judgment, the court affirmed that the Finance Act did not violate any constitutional provisions. The court further noted that Parliament needs to establish a legal framework to regulate public involvement as envisioned by the Constitution. Despite receiving criticism, Odhiambo welcomed the court's recommendation for the development of a statute to standardize public participation. She expressed optimism that if the Supreme Court revisits this matter in the future, it will offer clearer and more detailed guidelines on the appropriate methods, scope, and extent of public engagement.
