High Court to Hear AG’s Application on Prof. Kindiki's Swearing-in Block
Today at 11 a.m., the High Court will handle a request from the Attorney General (AG) and the National Assembly to overturn a decision that stopped Prof. Kithure Kindiki from being sworn in as Deputy President. Solicitor General Shadrack Mose submitted the request on behalf of the AG.The National Assembly also criticized the judge, Justice Richard Mwongo, for issuing the order, claiming he did so without confirming if he had the authority to deal with impeachment matters.
Backing the AG’s efforts, the National Assembly warned that pausing the Senate’s decision could cause a serious constitutional problem. They also argued that the judge’s order ignored key details, including the fact that the Senate’s decision had already been acted on.In response, Deputy President Rigathi Gachagua challenged the issue in court. Justice Chacha Mwita temporarily stopped Kindiki’s appointment and delayed naming Gachagua’s replacement until October 24, when the matter will be reviewed again.
