High Court Clears Senate to Proceed with Deputy President Rigathi Gachagua’s Impeachment

The High Court has dismissed an application by Deputy President Rigathi Gachagua to block the Senate from moving forward with his impeachment trial. As a result, the hearings will proceed as scheduled on Wednesday, October 16.

In a ruling delivered on October 15, Justice Chacha Mwita rejected Gachagua’s petition, which sought to prevent the Senate from acting on the National Assembly’s resolution passed on October 8. The court's decision clears the way for the Senate to fulfill its mandate in handling the impeachment process.

Justice Mwita explained that the Constitution grants Parliament authority over impeachment proceedings, and it is not the role of the judiciary to interfere in this process. However, he noted that the legal issues raised in Gachagua’s petition could be reviewed once the Senate completes its part of the impeachment process.

This ruling marks a significant step forward, with the impeachment hearings scheduled to take place as initially planned.
