7 years later the later baby Pendo is about to get justice as 11 police officers have been brought to book for the killing of Baby Samantha Pendo and 39 protesters in Kisumu County during post-election violence in 2017. 

Kisumu High Court Judge Kanyi Kimondo ruled that the senior police officers should appear in court on October 3, 2024 to face charges of murder. 

The judge dismissed the applications filed by the police officers arguing that the High Court had no jurisdiction to handle the charges under the International Crimes Act.

In the ruling Judge Kanyi Kimondo stated  that 11 Police Commanders and Officers have a case to answer in the case of Baby Samantha Pendo. The officers are being charged with 47 crimes against humanity, including murder, torture, and rape.

In 2017, police raided Nyalenda Kilo in Kisumu during post-election protests. Baby Pendo’s mother, fleeing teargas, encountered police brutality. Tragically, 6-month-old Baby Pendo was killed. The inquest began in 2019, holding senior officers and others accountable. In 2022, the ODPP charged 12 police bosses under the International Crimes Act that domesticated the Rome Statute in Kenyan law.

The accused officers are;Titus Yoma,John Chengo, Benjamin Kioma, Benjamin Leroma, Volker Edambo,Cyprine Robe wakio,Josephat Sensira ,James Rono,Lima Kogey,Mohamed Ali Guyo and Mohamed Baa.
